Section 11, Landlord and Tenant Act 1985

Your landlord has an explicit statutory obligation to keep in repair the structure and exterior of your home. This covers walls, roof, foundations, external walls, drains, gutters, stairs and the building's overall structural integrity.

HHSRS — Category 1 Hazard

Under the Housing Health and Safety Rating System, structural collapse and falling elements are classified as a Category 1 hazard — the most serious category. Your local council's environmental health team can require your landlord to take immediate action.

Building Safety and Social Housing Obligations

Social landlords have additional regulatory duties to maintain the safety and structural soundness of their housing stock. The Regulator of Social Housing and the Building Safety Act 2022 place further obligations on housing providers.

Defective Premises Act 1972

This Act imposes a duty on landlords who are responsible for maintenance or repair to take reasonable care to see that all persons who might be affected by defects in the property are reasonably safe from personal injury or damage to their property.

Important: Your landlord's repair duty applies even to pre-existing defects discovered after your tenancy began. You do not need to prove the structural damage happened while you have been living there — only that the landlord knew or ought to have known about it and failed to act.
